What Is a Confidentiality Agreement?

A confidentiality agreement, also called a non-disclosure agreement (NDA) or a confidential disclosure agreement (CDA), is a legal document between two parties that outlines confidential material, knowledge, or information in which those information are only shared between to the two parties involved. A confidentiality agreement restricts the access of third parties in the information that is being written down in the agreement.

There are three types of confidentiality agreements: unilateral, bilateral, and multilateral. Here is a short background on the three types of confidentiality agreements:

1. Unilateral confidentiality agreement.

This general agreement anticipates disclosing information to the other party and requires that the information be protected from further disclosure for a variety of reasons (i.e., maintaining secrecy of patent laws, protection of trade secrets in a legal manner, limiting disclosure of information before a press release is announced or published, etc.).

2. Bilateral confidentiality agreement.

This agreement, also called as a mutual non-disclosure agreement or a two-way non-disclosure agreement, involves two parties. Both parties anticipate disclosing information to one another and intends to protect each other from further disclosure. This type ofsimple agreement is common for organizations who are about to enter into a joint venture or merger.

3. Multilateral confidentiality agreement.

A multilateral confidentiality agreement meanwhile involves three or more parties in where one of the parties already anticipates disclosing information to the other parties and requires that the information be protected from further disclosure. You may also see sales agreement samples.

Items Covered in a Teacher Confidentiality Agreement

Here are some items you want to include when writing a teacher confidentiality agreement. You may add other information as well depending on the type of information you want to keep confidential.

1. Grades

This is one of the most basic items that should be listed in a teacher confidentiality agreement. Grades should only be disclosed between the teacher, the student, and the parents or guardians of the student. This standard confidentiality agreement is helpful for students who are struggling with their academic performance, and requires additional remedial or tutorial sessions to keep up with his or her other classmates.

Not all students maintain grades to keep an academic or athletic scholarship, and not all students maintain grades to achieve a class honor or school honor status. Some students just want to meet the passing grade requirement.

Take note that not every student is an Einstein or Hawking in the making. It will be very detrimental to the student’s confidence if he doesn’t pass his subjects and will be reprimanded by teachers and his fellow classmates alike for his low grades. You may also like license agreement examples.

2. Attitude issues

If grades or academic performance is not the issue of the student, it is his or her attitude and how deals with his fellow classmates and teachers on a daily basis.

Most of the time, it is the attitude of the student that derails him from achieving something great. Being disobedient, unruly, or downright disrespectful are traits that should be fixed at home. But there are times where the parents or guardians are not available to discipline their kids, so the task is left with the teacher. You may also check out employee confidentiality agreement.

A teacher confidentiality agreement is needed when the concerned student has done a grave misconduct and the information regarding the misconduct needs to be kept private, not only to retain the integrity of the student but also the integrity of the school. The student might be expelled depending on the school’s policies, but that information should not go beyond school premises. You may also see non-compete agreement examples.

3. Personal issues

Personal issues are also items that can be incorporated in a teacher confidentiality agreement.

Students experience personal issues all the time, and it is no surprise that teachers come to the aid of their students. If the student’s parents or guardians are not around to deal with the problems of their children, teachers act as stand-ins and make sure their students still perform at a high level even though the students are experiencing personal problems. You may also see HIPAA confidentiality agreement examples.

Similar to other non-disclosure information listed in a teacher confidentiality agreement as mentioned above, personal issues should be restricted only between the student and the teacher. This is to avoid the student being bullied over personal issues he cannot control, or being the subject of rumors by fellow students and faculty. You may also like service level agreement examples.

Among the personal issues the student might experience include having contracted a disease, encountering financial problems, experiencing family problems, etc.

4. Extracurricular activities

One item that can also be listed in a teacher confidentiality agreement is the student performing extracurricular activities especially outside the school premises. It is true that the extracurricular activities need to be approved by the school board or academic governing body especially if the activities are held outside the vicinity of the school or university. You may also check out consulting agreement examples.

The school board will also be asking details of the activity, not only to know the whereabouts of the student but also guarantee his or her safety.

But there are some activities that don’t require the entire details to be disclosed, especially when it puts the school at risk from various stakeholders. In this type of basic confidentiality agreement, it is not only the teacher and the student who will be the parties involved but also the school board or school governing body (principal, school superintendent, school director, etc.).

Some popular extracurricular activities include sports competition or tournaments, physical training activities, and educational field trips. Take for example an unfortunate accident wherein a student competes in a track-and-field event and breaks his leg, the school will not disclose the injury as it might cause an uproar between the student’s parents and other parents. You may also see business sale agreement examples.

The injury might result in parents pushing for the ban of sports activities, which is not only detrimental to student athletes, but for the school as well as they aim to provide a visual, aural, verbal, and physical learning experience for all of their students.
