Certificates: A Brief History

Certificates have been known to exist since the 1500s. Many civilizations have recorded specifically births and deaths as a basis for taxation in the early forms of governance even during ancient times. However, one of the earliest and closest form of a Inspection certificate is that to be certifcate of registers from Scotland’s Registration Act 1617.

Before that, in all other countries, the land belonged to the kings, monarchs, and feudal lords and everyone else was tenants under the grace of the monarch. A more formal and the basis for occupancy certificate of title was based on the Real Property Act of 1858 in South Australia by Sir Robert Richard Torrens which was named the Torrens system.

Torrens System for Certificate of Titles

The Torrens title system gives the state the power to guarantee a title and compensation scheme support in the event of losing the title due to private fraud or the state operation’s error. This system operates in conjecture to three principles:

  • Mirror Principle – Means that the registry precisely and completely reflects the present facts relating to the title to each registered lot. As a result, any dealings involving the particular lot must be entered in the register for transparency.
  • Indemnity Principle – Is equivalent to the clause of compensation from loss due to fraud or official registrar errors.
  • Curtain Principle – It signifies that the certificate of title bears all and any information relating to ownership of the lot or land. No other documents are needed to prove ownership in contrast to the previous Private Conveyancing System.

The Torrens system was second introduced in the British colony of Vancouver Island in Canada in 1861 used by three provinces namely Alberta, Saskatchewan, and Manitoba.

The Birth and Death Certificate

Evidence of births have long been recorded since the ancient times or before the time of Jesus. China, Greece, Egypt, Persia, and Rome have long held records of births and deaths in context to the collection of taxes and records of birth held by the Church.

The first form of birth certificates was introduced by the Roman emperor Augustus in 27 AD and was written in Latin until the time of Emperor Alexander Severus in 222 AD. This was not in any way compulsory and did not have any legal implications or penalties.

In parts of Europe and North America, churches still held the records of deaths, births and marriages. In 1639, the Massachusetts Bay Colony was the first secular court to have such records but were not standardized throughout the country.

England started recording their Civil registrations of births, marriages, and deaths on July 1, 1837 but was not compulsory until 1875 following the Registration of Births and Deaths Act of 1874. United Kingdom, on the other hand through their government agencies, started the compulsory formal system of registration of births and deaths in 1853. The United States of America did not standardize this system until 1902.

Presently, there are two types of copies of certificates for birth issued by some governments which originated from England and Wales:

  • Full Certificate – This document is named as a Certified Copy of an Entry and is a copy of the original entry in the birth register. Information included in such a certificate are complete details of the birth including occupations for both mother and father.
  • Short Certificate – Named as Certificate of Birth shows only the full name, sex, date and place of birth of a child and does not indicate any particular information regarding the parents of a child.

It was required by law, to have both certificates to prove parentage and verify the identity of a person.

For whatever purposes it may serve, certificates play a vital role in our lives not only as proof of our identity but also as a reminder of our history and where the acquisition of such originated from.

Marriage Certificates: A Personal and Legal Union

Many individuals consider marrying for a variety of different reasons from social, emotional, spiritual, financial, legal, and the religious aspect. The concept of marriage and the reasons behind marriage may have changed over the years but the basic concept behind marriage is still in its purest form a contract or an agreement.

By definition, marriage is defined by the following:

  • Binding – Whether by custom or law, marriage is socially and legally binding. A couple is recognized as married in the eyes of culture, religion, and the law in any country, state or province.
  • Offspring – Considered to be not merely an act of propagation of species but as a venue to legalize and validate children and future heirs. This provides children social stature or acceptance to society and rights as members of that society.
  • Ownership-Partnership Rights – Not to be sexist, marriage defines the ownership or partnership of the individuals involved in a marriage. It establishes legality in terms of fatherhood or motherhood to a child and most commonly (and sometimes sadly), joint monopoly over the property, funds, social affinity, and sexuality of a partner.
  • Sexual Access – Yup. The S word. As a result of entering a binding contract, a right to demand sexual access is granted together with the obligation to yield to such demands. The point is, each party is obligated by law and theoretically by church to such rights.

The Need for Birth Certificates

Birth signals entry to the world and a birth certificate signals entry to humanity and society. Birth certificates upon issue create your identity in conformance or subjection to the registering body.

While many conspiracy theorists may share their aversion for the whole process, this is just how society was set up and how any government or system tracks its members or subjects.

Since a birth certificate is proof of an individual entity and registry to a known system, it is used and required for many different purposes and documentation applications which include the following:

  • School Registration – Schools require birth certificates mainly to ascertain age of an applicant to properly place them in their level or class. It also serves as proof of identity and whereabouts of a person.
  • Marriage – Again, used as proof of identity for an individual to enter into the legal bond of marriage.
  • Licenses – Some agencies require birth certificates in obtaining licences to determine the correct age and identity of an applicant. This is important as some licenses are not granted due to age restrictions.
  • Social Security – in applying for social security, identity of an applicant is important in determining which state you are from and any other associated legal requirements for that specific state or province.
  • General Identification – Some institutions require additional proofs of identification and a birth certificate most certainly is generally accepted. Institutions such as banks or job applications commonly require applicants to submit birth certificates as proof of their identity claims.

The enumerated reasons may not hold the full list of answers why the birth certificate holds an important role in our lives but there is definitely truth behind it.

Death Certificates

News of death of a person you know, or any death of a person, is definitely not a reason to smile even if you harbor deep-seated feelings of hate for that person. A person’s death or passing initiates emotions of melancholy and sadness.

However, it is still important to obtain the death certificate of an individual for the following various reasons:

  • Insurance Claims – Mainly all death certificates are obtained as a requirement for insurance claims. Claiming benefits for insurance may be slow but a needed process to collect benefit claims for an insured person.
  • Estates and Real Property – With the death of a legal partner (wife or husband), any properties left behind will need to show certificates of death in order to claim rights in selling or obtaining such properties. Multiple copies may be needed as a requirement to investment claims or estate holdings.
  • Pensions – Pension benefits are extended to the wife or husband of a deceased and a death certificate is needed as proof for the transfer of those benefits.
  • Medical Benefits – In some countries, medical benefits extend to the spouse or child of a deceased individual. Death certificates are needed in establishing proof of relationship to the deceased.
  • Future Marriage – Again, the death certificate determines the identity of the deceased and the relationship you have. If a married individual decides to remarry after the death of the partner, then the death certificate can help in resolving the matter.

Thus, for the above reasons, acquisition of a death certificate carries with it importance in a legal capacity as it is a requirement prior to acquiring any benefits laid down before the death of a known individual or person.

In a sense, the death of a person can mean the continuance of the life of another. Examples of death certificates that include a standard death certificate and a blank death certificate can be found in the page for your reference.

Certificates Relating to Work

Modern certificates have long had a role to play in the advancement of our careers and admission to work in general. Providing concrete evidence of credentials or achievement greatly boosts chances in getting that promotion or landing that job. Some certificates relating to work are also issued to grant qualification to do such work such as licenses.

Generally, a work certificate has the following basic components:

  • Name of the company issuing the certificates. Some usually are written in documents with the official letter head of a company.
  • The employee’s complete name and details including age and nationality. Information may also include date of birth in cases of providing proof of identity.
  • The position held in the company during the employee’s stay or work with the company. Additionally, lateral transfers within the company and any additional assignment may be mentioned.
  • Duration of the work done with the company. Total time in terms of weeks, months, and years that the employee worked in the company up to his resignation or transfer to another company.
  • Main assignments and projects completed. A summary of the key roles and responsibilities assumed by the employee and the milestone projects that may have been completed during his time with the company.
  • An assessment of the quality of work, skills displayed and used during work, and general conduct during the duration of work in the company.
  • The reason or reasons for which the issuance of such a certificate was made (usually per the employee’s request for recommendation).
  • The date which the certificate was issued.
  • Accompanying signature of the immediate superior or head of recruitment of the company.
