How to Create a Rental Agreement

Whether you’re making a non-disclosure agreementwork for hire agreement, or a rental agreement, you should know that any of them will require specific information in order to tell both parties what terms needs to be agreed on before anything official can take place.

So to make sure that you’re able to create a proper rental agreement, here are a couple of steps that you’ll need to follow:

1. Include Information About the Property to be Rented

If you were to make something like a settlement agreement, then wouldn’t you want to know the details regarding the solution that’s going to be taken regarding the disputing parties over a legal case? Well, it’s the exact same thing when one wants to learn about the property that he or she is willing to sign a rental agreement for. So what you’ll have to do is describe the property that will be rented, the address, and the name and address of the property owner. If there is a property manager and that he or she is separate from the landlord, then you’ll also want to include that person’s information into the agreement.

  • In the agreement, you’ll also want to make sure that you have information of the renter. Although you can always place it in yourself, it’s best that you leave blank lines in which he or she can add to the document to make it more flexible; you’ll never know if there are crucial details that you may miss out so it’s best to have the renter put it instead. You may also see lease agreement

2. Talk About the Terms of the Rental Agreement

You’ll want to point out just how many days of notice the landlord must receive before the the termination of the agreement.

  • When you decide to create a rental agreement, they usually tend to be on a month-to-month basis. If you want an even longer period of time, then you can always consider leasing out your property. You may also see  tenancy agreement

3. State the Consequences if the Agreement is Broken

Much like a tenancy agreement or a reseller agreement, a rental agreement will always have consequences should either party do anything to break whatever terms have already been set. So what you’ll want to do first is research on the laws of your country or state regarding eviction and/or termination of a rental agreement. Once you’ve already managed to fully understand these laws, you may then proceed to writing down the consequences into the document.

  • A good example of a consequence would be if the tenant continues to fail rent. Should the tenant continously fail to comply with the terms in which the rent has to paid and when it has to be paid, then the agreement can state that the tenant has forfeited all or some of the security deposit that was given at the time of the tenancy period.

4. Specify Everything form the Payment, Security Deposit, and Fee Policy

If you were to create something like a service level agreement which talks about the terms in which the service provider will be compensated, then you’ll also want this to be the case when you’re writing down the rental agreement. You’ll want to state just how you want to receive the payment from the renter as well as the exact amount that you should be receiving.

  • In most countries, there is a required grace period before a renter is to start paying the rent. Define the late fees once that grace period has passed to ensure that the renter knows the consequences if he or she is late to making the the necessary rental payments. You may also see purchase agreement

5. Be Sure to Create a Repair and Maintenance Policy

There will be times where it can’t be helped that a property will end up getting damaged or in need of repair. So in the event that does happen, you’ll want the renter to be aware of the repair and maintenance policy of your establishment and you’ll want to hand the tenant all the information needed to learn about the proper procedures. You may also see transfer agreement

  • Refer to local and state laws to help you create the repair and maintenance policy.

6. Determine and Specify an Additional/Optional Policies Which You Would Like to Include

These may include policies concerning pets, utilities, number of occupants, smoking, parking, or just about anything that has to do with the property that’s being rented.

1. When you think about it, there are many different kinds of policies that you can probably include into the rental agreement document. The only thing that you have to do on your end is specify each and every single one that you decide to include so that the renter is made aware of all them and has all the information needed to uphold these policies. You may also see purchase agreement

2. It’s usually up to the landlord if he or she is to allow some pets, all pets, or no pets. The decision can also be affected on the laws governing your area meaning that you’ll want to read all about them first before coming to the decision as to whether or not you allow pets into your establishment.

3. Specify who will be paying for the utilities and whether specific providers will need to be used. It’s pretty much like having a credit agreement where you discuss the terms of a loan, but in this case you’re talking about what has to be provided and by whom. You may also include whether and where satellite dishes will be mounted in the property

7. Consult a Real Estate Lawyer

Considering the fact that the laws regarding rental agreements will depend entirely on the governing body within your area, you may just want to ask for the assistance of a real estate lawyer. This way, you’ll makes sure that your rental agreement will follow the law, making that one less worry on your end. Just remember that this will cost you a bit, but it’s still worth the cost to make sure you have in iron-tight rental agreement. You may also see attorney agreement

8. Proofread the Agreement

Once you’ve written down everything that the document will need, you’ll want to make sure that it has no errors. Avoid extra legal fees by making sure the document is as accurate and complete as possible before submitting it for review. Be sure that there are no mistakes in terms of grammar, spelling, or the information regarding the property that’s to be rented. You may also see commission agreement
