What Is Guardianship?

A guardianship is the duty of being rightfully responsible for the supervision or custody of someone who is unable to handle their duties.

What is a guardianship agreement?

It is a legal written document or a written agreement between the guardian assigned and the parent to transfer the responsibility and in some cases the raising of a child to someone else.

How to Tell If the Guardianship Agreement Form Is Authentic?

In some guardianship agreement forms, you will find a notary below and some other legal information.

What to Fill Up in a Guardian Agreement Form?

When you are about to fill up the guardianship form, the things you need to look out for are:

  •  The basic or general information

Under this, you will often find the name of guardian/guardians which you must provide his or her or their full names. Beside it would be your complete name and the complete name/names of your child/children. These need to be filled up correctly to avoid any confusion. The general information also includes the birthday/birthdays of your child/children and the relationship of the guardian/guardians to the child.

  • Agreement paragraph

This is the important information in the guardianship agreement since this is where you are going to fill out the dates as to how long you hand over the responsibility of caring for your offspring to said person. As well as anything that may happen to your child under the care of the guardian, he or she is allowed to take the child to receive immediate care.

  • Your consent.

This is as important as the rest of the information that needs to be filled out. As long as you were able to consent and with witnesses to what you filled out is complete and correct.

What Not to Expect From a Guardianship Agreement Form?

What should not be in the form is if you are able to give your child away permanently. Unless there is a signed letter from a judge for this matter, you are not expected to give away your child for good as the guardianship is merely based on the time and date you specified in the agreement form.

FAQs

Do I need to have an attorney present to have my chosen guardian to sign the guardianship agreement form?

It’s not always the case to have an attorney present to have your chosen guardian to sign the form. Unless it’s a more serious case then having the attorney present is okay.

What should I do if the chosen guardian refuses to sign the guardianship agreement form?

If the case happens, you may ask someone else to sign instead.

Does the guardian have to be a relative or can a friend be considered a guardian for my children?

The most common guardians for children would often be your family members as they are often the ones approved by court. Having a friend of the family as your guardian may be okay as long as he or she is also approved by the judge. Remember, you must put a relationship title to your chosen guardian. This is so in case anything goes wrong, you may take back the guardianship agreement.

A guardian agreement is never complete or valid unless the following information and signatures are needed to complete the agreement. With that being said, I hope you have any luck in finding a guardian for your offsprings.
