What Is a Roommate Sublet Agreement?

To start let us first define what a sublet is. So a sublet is a kind lease agreement between the original tenant and another tenant. This is considered a sublet due to the fact that it is between two different tenants who are going to be in an agreement with renting a space. So with that information in mind, a roommate sublet agreement is a kind of tenancy agreement between the tenant and the subtenant. This kind of agreement does not need the original landlord nor the tenant to act as the landlord.  However, the only difference between a roommate lease agreement and a roommate sublet agreement is the fact that the tenant in the roommate sublet agreement does not act as the landlord nor are they required to do so.

This means that the agreement does not need to be taken to the landlord for it to be a legally binding agreement. The roommate lease agreement however needs to be an agreement between the landlord and the tenant. The whole purpose of a roommate sublet agreement is to make sure that the new tenant you are planning on allowing to rent with you would know that this can be both temporary or permanent. That the responsibilities, rules and regulations, the terms and conditions are the same with what the agreement you were given when you were given by the original owner or the landlord.

How to Write a Roommate Sublet Agreement?

Are you thinking about having a roommate to lease a space or a bed? If so, you would need a roommate sublet agreement. Here you have your tips to get you started with that roommate sublet agreement.

1. Get All Your Information Straight

Information in this tip means all about your roommate, their name, their contact information, and the place they are going to be staying. This would also mean that you have to add your name, your address, the contact information in the agreement. This is entirely optional, but some agreements would also want you to add the name and contact information of your landlord in case of any emergency or issues.

2. Make Your Terms and Conditions

You need not have to follow the same terms and conditions of the contract you had with your landlord. However, your terms and conditions should at least be easy to understand and easy to follow by your roommate. Since the words or the terms would be used throughout the agreement, it is always best to make them clear and concise.

3. Explain the Reason for the Sublet

The reason for the sublet must at least be explained, either through discussion or within the agreement. Of course there are some who would do booth, just in case of any issues regarding the sublet.

4. Fill Out the Agreement

When everything has been settled, it is time you fill out the agreement you just made or the agreement you just downloaded. Make sure that all the information being asked and required from the agreement are true to what the person stated. In addition to that, make sure by asking questions just so no mistakes are made.

5. Print and Give a Copy

Lastly, print out the agreement, and give a copy. Give a copy to your roommate the agreement that you both have agreed on and signed. This way, in case of any issues, the roommate would be able to check the agreement for anything they may have missed.
